The law establishes new requirements for road safety

The Law «On Road Traffic» (Law No. 900 dated 01/19/2024) was signed by the President.

The law separately establishes the rights and obligations of the road owner, the obligations of transport owners to ensure road safety, as well as the rights of drivers working under an employment contract.

The enterprises, institutions, organizations or individuals in charge of the road are the owners of the road.

The road owner has the right to participate in the coordination and approval of road construction, repair and reconstruction projects, as well as in the organization of repair work.

A person who drives a vehicle by virtue of fulfilling his official or labor duties, including on the basis of an employment or civil law contract with the owner or other owner of the vehicle, is not the owner of the vehicle.

Vehicle owners are required to:

- operate technically sound vehicles;

- to allow persons with appropriate qualifications and who have passed a medical examination to drive vehicles;

- to carry out compulsory insurance of their civil liability for causing harm to the life, health and (or) property of other persons when using vehicles;

- do not allow people who are intoxicated or under the influence of psychoactive substances or excessive fatigue to drive vehicles.

According to the Law, drivers working under an employment contract have the right to:

- obtaining reliable information from the employer about the route, the cargo being transported, the existing threat to their life and health, as well as measures to protect them from the effects of harmful and (or) dangerous factors;

- provision of personal protective equipment, special clothing;

- participation in the consideration of issues related to the improvement of road safety conditions;

- refusal to carry out transportation in the event of a situation that poses a threat to their life and health;

- advanced training and professional retraining in the field of road safety;

- compensation for damage caused to their health in the performance of their work duties;

- appeal against unlawful decisions and actions (inaction) of the employer in the field of traffic.

During the repair of road sections, the roadway may be closed for travel by no more than 50 percent.

According to the Law, when carrying out reconstruction, major repairs or repairs of road sections, the roadway on these sections of the road may be restricted or closed for travel by no more than 50 percent.

If it is necessary to close the carriageway on sections of the road by more than 50 percent, a detour of these sections of the road should be provided.
